Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your use of HiveCloud at https://hivecloud.tech (the “Service”), operated by HiveCloud (“we”, “us”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Email Communications Policy.
If you do not agree, do not use the Service.
2. The Service
HiveCloud is a web platform for uploading aerial or drone imagery and running photogrammetry workloads (including OpenDroneMap) on decentralized compute providers. The Service is provided on a beta basis: features, pricing, and availability may change without notice.
We do not guarantee uninterrupted access, specific output quality, or fitness for a particular surveying or legal purpose. You are responsible for validating results before professional or regulatory use.
3. Accounts
- You must provide a valid email address and keep your credentials secure.
- Email verification is required before full use of the Service.
- One person or organization must not maintain multiple accounts to evade limits, billing, or enforcement.
- You must be at least 16 years old, or the age of digital consent in your country if higher.
- We may suspend or terminate accounts that violate these Terms or pose abuse or security risk.
4. Your content
You retain ownership of imagery, project data, and outputs you upload or generate (“Your Content”). You grant us a limited licence to store, transmit, and process Your Content solely to operate the Service (including copying to object storage, packaging for compute jobs, and delivering results to you).
You represent that you have all rights, permissions, and lawful bases needed to upload and process Your Content, including rights from property owners, data subjects, and aviation or privacy rules that apply to your captures.
5. Acceptable use
You must not use the Service to:
- Upload or process imagery you do not have the right to use.
- Violate privacy, surveillance, export-control, or aviation regulations.
- Transmit malware, probe systems, or interfere with the Service or provider network.
- Send spam, phishing, or unsolicited bulk communications through or via the Service.
- Attempt to access other users’ data or circumvent billing or access controls.
We may remove content, cancel jobs, or terminate accounts for violations. Report abuse to info@hivecloud.tech.
6. Decentralized processing
Jobs may run on independent compute providers (e.g. on the Golem Network), not on hardware we own. Before starting a job you must confirm that you understand this.
During a job, providers may technically access files required to run the workload. We select providers through market mechanisms and contractual tooling, but we do not fully control provider environments. See the Privacy Policy for how data is handled.
You accept the residual risk of third-party processing in exchange for lower compute cost.
7. Fees and payment
- Processing is billed against account credit in EUR (or as shown in the dashboard). Prices reflect underlying compute cost plus our markup.
- Top-ups are processed by Mollie or another payment provider we configure. Card and payment data are handled by the payment provider, not stored on our servers.
- Credits are consumed when jobs run. Failed jobs may still incur charges if compute was used; see in-app job details.
- Promotional signup credit, if offered, may be withdrawn or changed at our discretion.
- Except where required by law, fees paid are non-refundable once credit is applied to your account.
We may change pricing with reasonable notice where practicable; continued use after a change constitutes acceptance.
8. Availability and support
The Service is provided “as is” and “as available”. We do not commit to a service-level agreement. Support is best-effort via info@hivecloud.tech. Maintenance, provider outages, or network issues may delay or fail jobs.
9. Our intellectual property
The HiveCloud name, branding, website, and platform software (excluding Your Content and open-source components) are our property or our licensors’. You may not copy, reverse engineer, or resell the Service except as allowed by applicable open-source licences in our repository.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, abuse, or legal requirement.
On termination, we may delete Your Content after a reasonable period. Export anything you need before closing your account.
11. Disclaimers and liability
To the fullest extent permitted by law:
- We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for indirect, incidental, special, or consequential damages, or loss of data, revenue, or business.
- Our total liability for any claim relating to the Service is limited to the greater of (a) amounts you paid us in the twelve months before the claim, or (b) EUR 50.
Nothing in these Terms limits liability that cannot be limited under applicable law (including death or personal injury caused by negligence, or fraud).
12. Governing law
These Terms are governed by the laws of the European Union and, where mandatory rules apply, the laws of the member state in which the operator is established. Disputes should first be raised with us at info@hivecloud.tech. Where required by law, you may also use EU online dispute resolution mechanisms.
13. Changes
We may update these Terms. We will post the new version on this page and update the “Last updated” date. Material changes may be notified by email or in-app notice. Continued use after changes take effect constitutes acceptance.
